Diebert, Bancroft & Ross accused of misrepresentation DB&R is not approved to the required" armor specifications. Currently, DB&R Is not approved to the military specifications for quality as required by MIL-I-45208A. DB&R was qualified in 1984, and a periodic update re-survey inspection was requested on 26 November 1985 to continue their quality specification approval. Per Mr. R. Fritz, DB&R did not desire to expend funds to re-calibrate quality inspection equipment, and DB&R requested cancellation of the re-survey. Therefore, DB&R is currently not approved to the required military quality specification. Facts DB&R has never been the low bidder on any MIA1 casting. DB&R has been provided the oppor- tunity to submit bids on 30 M1A1 tank castings during the past two years, and they have only responded to six of these requests. DB&R has not been awarded any contracts because of their failure to meet armor and quality specifications, and their high pricing quotes submitted. Their bids ranged from a high of approximately 700 percent to a low of approximately 15 percent above the winning bid. DB&R was provided the opportunity to bid on two MIA1 turret ring castings for the 7th year of M1A1 production. They did not respond to the bid for the MIA1 tank hull rings and submitted a non-competitive bid for the turret rings. Approximately three weeks after the bid closing date they submitted a second and unsolicited bid for these items. This bid could not be considered after the closing date and was rejected as non- responsive. It makes no difference if these quotes were lower or not. The total value of the M1A1 turret ring contract was not $40 million as alleged, but slightly less than $9 million. DB&R was provided the opportunity to bid on 28 M1A1 castings for a four year multlyear procurement period for the eighth through eleventh year of production. DB&R chose to bid only FROM PAGE ONE | '-//z.- ),,, four castings, and their bids on these , items were extremely high ranging from approximately 700 percent to 250 percent above the winning bids. None of the DB&R bids were for MIA1 turret rings in this solicitation. DB&R has been treated fairly. They have been invited to submit bids on every casting requirement for the MIA1 tank that is subcontracted. It was their choice not to become armor and quality military specification qualified, and to not submit bids for the M1A1 casting work, and to submit unrealistic non- competitive cost quotes for those items they submitted bids on.
